ACTIVITY WAIVER
In consideration of participating in the Green Light Series and any and all of The Red Well Foundation activities, programs, classes and events, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence The Red Well Foundation any other association, and its owners, directors, officers, employees, agents, volunteers, participants, and all other persons or entities acting for them, the City of Chicago, the landowners, sponsors, volunteers, the Chicago Park District, contractors and any other entity or individual involved in the production of the event (hereinafter collectively referred to as “Releasees”), on behalf of myself, my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:
I acknowledge that participating in the Green Light Series, as presented by The Red Well Foundation, activities involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death and property damage. Risks include but are not limited to falling from heights, tripping, exhaustion, heat stroke, cardiac arrest, rolled ankles, joint sprains, broken bones, torn ligaments or other injuries as result of falls or contact with other participants; death; brain damage; medical conditions resulting from physical activity; and damaged, clothing or other property.
I understand such risks simply cannot be eliminated, despite the use of referees and/ or safety equipment, without jeopardizing the essential qualities of the activity. I have fully informed myself of all of the details of the activity and state that I have the necessary physical abilities, skills and knowledge to participate in the activity. My participation in this event is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
I recognize and acknowledge that the activity involves risks of bodily injury, death and property loss. I hereby agree to, and do, assume the full risk of any injuries, including death, and of any property loss and of all expenses, costs, damages and losses that I, or my child on whose behalf I am signing, may sustain as a result in participating in any and all activities connected with or associated with the activity. There is no measure available that can eliminate risk of injury or death and so by my voluntary participation, I accept this risk of injury or death and hold harmless all Releasees.
In the event of an emergency, I authorize the Releasees to secure, from any licensed hospital, physician and/ or other medical personnel, any treatment deemed reasonable and necessary for myself and/ or my minor child immediate care and agree that I will be responsible for payment for any and all such treatment rendered.
I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of- all risks that may be created, directly or indirectly, by any such condition.
I hereby grant permission to publish, use, reuse, reproduce, republish any photographs, videos, motion pictures, recordings, or any other record of me or my minor child’s participation in the event taken at the event. These images may be published in any manner, including advertising, periodicals, greeting cards and calendars. Furthermore, I will hold harmless the Releasees from any liability by virtue of any blurring, distortion or alteration that may occur in producing the finished product, unless it can be proved that such blurring, distortion or alteration was done with malicious intent toward me or my minor child.
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, lawsuits, damages, liabilities, losses, expenses, demands, or causes of action, controversies of every kind, known and unknown, present and future, which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
I agree to obey all event rules, particularly those involving safety, and I accept full responsibility for my failure to obey any such rules. I understand that the host reserves the right to dismiss anyone who disregards any event rules, causes a disturbance during the event, or otherwise jeopardizes the safety or enjoyment of other event participants.
I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
By checking the box next to this linked document , I agree that if I am hurt or my property is damaged during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the bases of any claim for negligence.
I have had sufficient time to read this entire document and, I understand that this activity might not be made available to me if I were to choose not to sign this release, and agree that the opportunity to participate at the stated cost in return for the execution of this release is a reasonable bargain.
I have read and understood this document and I agree to be bound by its terms. I am aware that this is a release of liability and a contract between myself and the Releasees and execute it of my own free will and without any reservation whatsoever.
I certify that I am at least eighteen (18) years of age, that I am of sound mind, and that I have carefully and fully read and understood all of the terms, content conditions and effects of this Waiver and Release from Liability.
